Before purchasing from us, you should read our terms and conditions set out below. All sales and transactions are conducted under these Terms and Conditions. By placing your order with us it is deemed that you agree to our Terms and Conditions as detailed here.

01. Website Terms of Use:

When viewing this Website and purchasing or ordering goods from us you accept that it is done so under our terms and conditions.

Your notice is drawn to such Terms & Conditions.

The website is provided by the company Dean Organ Builders, 'The Music Box Shop', for the personal use of their customers and may not be copied.

The publisher accepts no liability without limitation for any losses or damages to property or person arising from using this website, including any loss of profit, damage to equipment or data, interruption of business, or any other damage, direct or accidental.

The publisher also accepts no responsibility for prolonged use of telephone lines as a result of viewing this website & the use of the links to other websites.

This Website and all transactions are subject to English Law only.

02. Terms of Purchase / Ordering:

All prices quoted are in English Pounds Sterling £ and are Ex Works Bristol, England unless otherwise stated.

Prices include VAT where applicable at current rate, (export sales shipped will be zero VAT rated).

Our company trading name is Dean Organs (we use Shop 4 Music Boxes, The Music Box Shop, Dean Organ Builders & Music Shop Direct as our trade mark shop names) & our VAT number is 736 4158 26.


Our EORI number is GB736415826000

Upon ordering, you will receive an order confirmation via email (if you don't have email, this confirmation will arrive normally with the goods or within 7 working days after order whichever is sooner).

All goods must be paid for in full before they are despatched.

For out of stock goods or special order items where a longer delivery time has been specified we will contact you to let you know our earliest delivery time. You will only be charged for these goods, once they are ready for despatch, unless previously agreed otherwise.

Many items featured are handmade or finished so it is expected that colours and designs may change slightly from the pictures and details shown. Some items sold from our Catalogue & Website are manufactured outside of our own workshops, in the Far East as well as other parts of Europe.

Due to Royal Mail & Courier terms, it is the customers' responsibility to provide us with the full and correct delivery address including: - 1. The house name or number.2. The street or road name.3. The village or town. 4. The county. 5. The correct post code.6. The country.

If our delivery service is unable to deliver because one of the above is missing, and the parcel is returned to us, you will be contacted by our sales team to arrange re delivery and you will be charged again for this second delivery.

As all deliveries require a signature, you understand that someone has to be in to take delivery. If you are out a card will be put through your door so you can call Royal Mail or the Courier to arrange re-delivery.

PLEASE NOTE, if you are out and fail to contact Royal Mail or Courier within 1 week, the parcel will be returned to us and will incur an extra postage charge to resend.

02.1 Description Specific To Mechanical Organs :

When we provide a quotation or order for a specific mechanical organ from our range, it will be referred to as 20, 30, 35, 36, 48, 52, 65, 87, 89, 98, 112 keyless or keyed or similar description.  This description will be deemed to mean our standard model as currently produced for the particular given size.  The specification of that particular instrument will be our standard production model at the date of order or quotation.  That model may alter depending on our design parameters at that time and not necessarily be identical to a previous build as we constantly improve and refine design.  Therefore, should you require a specific break down of the current model you should request this in writing from us.  Should the specific instrument ordered or quoted include a decorative facade, unless otherwise stated this will be the standard facade of back board and carvings, painted in basic style.  It will not include any specific painted scenes or carved mechanical figures, these will always be quoted separately at extra cost.  The percussion fitted to an instrument will be the standard percussion provided for that model specification at the date of build.  Once an order is placed it is deemed that you accept our standard current model of the particular instrument ordered as is being built at that date.

02.2 Description Specific To Custom Made Mechanical Organ Parts:

When we provide a quotation or an order is placed for a custom made specific mechanical organ part (i.e. not a stock part), it will be referred to as "primary chest, wind chest, drum action, keyframe, bellows or another similar description".This description will be deemed to mean our standard model part, specification, size and design as currently produced for the particular part described.  The specification and physical size of that particular part will be our standard production model at the date of order or quotation.  That model may alter depending on our design parameters at that time and not necessarily be identical to a previous part as we constantly improve and refine design.Therefore, any mechanical organ part ordered and being custom manufactured will be deemed to be ordered to our standard specification as stated above, should you require any part not to our standard manufacturing specification it is the purchasers responsibility at the time of quotation to provide written sizes and drawings for the part, if no drawings or size specification are received in writing at that time, then it is deemed that you accept our standard current model of the particular mechanical organ part, as is being produced at that date.By placing your order for a particular part with us it is deemed that you accept the above and understand that as the part is custom made specifically to your order that we are unable to offer refunds or take back such organ parts.

Please note the above is only applicable to custom made up parts and does not apply to standard organ parts as listed at our online sales site HERE where normal distance selling laws apply.

02.3 Perforated Cardboard Music and Paper Rolls For Mechanical Organs:


All musicians play and interpret music in their own way, this is also applicable to the various music arrangers that work for us, or supply us with musical arrangements and notation for mechanical organs, they interpret the musical work and produce a version in their own style and artistic way.

Therefore by placing an order with us for perforated card board music or paper roll music, the customer is deemed to accept our version/ notation /arrangement, of the particular tune ordered.

In placing your order you accept and understand that the tune we supply in music book or paper roll form, may vary from the original composer's composition or any particular arrangement or version of that tune you may have heard previously.

This is sometimes due purely to the arrangers artistic or musical style or to the limiting scales encountered on a particular mechanical organ, where it can be necessary to change the key, transpose the work and in some cases rewrite certain sections to accommodate the scale. (This is common practice when arranging for mechanical organs particularly on the smallest instruments where scope is very limited.)

By placing your order you are deemed to accept our music book, paper roll or midi version and accept any artistic and musical changes we may have applied to our version of the work.
By placing your order for a particular tune in music book or paper roll form with us it is deemed that you accept that music books and paper rolls are not returnable just because you do not like our particular musical interpretation, version or arrangement. We do not operate a sale or return policy as all of our music is custom made and cut specifically to your order, we are unable to offer refunds or take back music books or paper rolls.


02.3 (A) Please note all music orders for midi format music, must be paid for prior to despatch, we do not operate or offer credit accounts on this format of organ music.

02.4 Supply of Blank Cardboard Music Books for Making Perforated Music:

All blank cardboard for the manufacture of music books is sold subject to Proforma.

As the cardboard is cut down specifically to your size it will not be cut until your payment is received and cleared at our bank.

Once the cardboard is cut it is not returnable because it will have been specifically cut down to match your order and size.

Once the card has been cut to size we cannot accept cancellation of that order or make a refund. Therefore by placing an order with us for blank perforated card board, the customer is deemed to accept our terms of supply on this product.

We do not operate a sale or return policy on blank cardboard book as it is custom made and cut specifically to your order, we are unable to offer refunds or take blank perforated card board back.

03. Product Guarantee/Warranty:

All new products are guaranteed for 1 year from the purchase date against faulty components and workmanship. If the item becomes faulty because of faulty parts or workmanship during the aforesaid period you must inform us within 7 working days of the fault occurring and we will repair or replace the goods with the same or similar (if the item is no longer produced) free of charge.

We cannot guarantee goods that become faulty through misuse, neglect or damage or items that are only designed for short term usage and have a natural short life span, such as guitar strings, batteries etc.

Please note the musical carousels and collectable figurines are generally intended as decorative items for occasional use. Should the musical movement be wound and used every day the life expectancy will be reduced due to wear on the components of the musical movement.

03.1 Warranty specific to mechanical organs:

Dean Organ Builders warrants all products as per our standard terms and conditions which are viewable at our website.  This warrants all mechanical organs to be free of defects in material and workmanship for twelve months from the date of collection.  Not covered under this warranty is normal wear and tear, neglect or misuse of the organ and operation in an application or manner not approved by Dean Organ Builders, and alterations not performed by Dean Organ Builders.  Any items supplied within the mechanical organ that are manufactured by others shall be warranted under the respective manufacturers' policy.  Dean Organ Builders will provide any support required ensuring that warranty service by others is handled in a prompt and professional manner.  Dean Organ Builders warranty is limited to the repair or replacement of the items supplied by Dean Organ Builders.  At no time will Dean Organ Builders be liable for any of the costs to the buyer for labour, transportation or down-time resulting from defective organs furnished by Dean Organ Builders or our suppliers.

To comply with our warranty the complete mechanical organ must be returned to Dean Organ Builders at the buyer's expense.  Disassembly of the organ will invalidate the warranty.

The warranty is also subject to a 6 month commissioning service which is chargeable to the buyer.  This service must be carried out at 6 months from the delivery date.

Disclaimer of liability.  Dean Organ Builders shall not be liable to the buyer in respect of any claim, demand or action, irrespective of the nature of the cause of the claim, demand or action alleging any loss, injury or damages, direct or indirect which may result from the use or possession of the mechanical organ, or for any loss of profit, revenue, contacts or savings, or any other direct, indirect incidental, special or consequential damages arising out of your use of or inability to use the mechanical organ, or the breach of these terms or conditions whether in an action in contract or based on a warranty even if Dean Organs have been advised of the possibility of such damages.

04. Return of Faulty/Damaged Goods:

If upon receipt of your order the goods are damaged or broken, please email or call us immediately or within 7 working days to let us know - we cannot accept claims for broken items if we are not informed within this time upon receipt.

Depending on the size of item/type of goods, we will inform you of the best way to return them by either royal mail post or courier. Once we have informed you of the way to return the goods please re-pack & send (with the original packaging and your receipt) them back to us. Please ensure you obtain a receipt and proof of posting from Royal Mail or the Courier.

Upon receipt of the returned damaged goods, we will send a replacement As Soon As Possible at no extra cost.

05. Cancellation of Orders & Returns.

Under the 'distance selling act' if private customers wish to return goods due to cancellation of order they must give us Written Notice of the cancellation and return the goods (at customers own expense) in the condition supplied along with all original receipts and written confirmation of cancellation within 7 working days after the day of receipt.

Providing the previous statement is adhered to, we will issue a refund within 30 days of receipt of the returned undamaged goods.

Card transactions can only be re-funded with the returned card receipt and only onto the original purchasing card. Cheque payments already cashed will be refunded with a cheque payable in the name of the original order.

Exclusions :We cannot accept cancellations or give refunds for any personalised goods (i.e. goods made up to your specific order such as a custom fitted tune, individually made pipe organ, perforated music or other special order for you).

All Pipe Organs are made up specifically to customer order and cannot be returned under distance selling rules. You must contact us first before trying to return an organ, as we reserve the right to refuse return under these exclusions.
If under very exceptional circumstances, we agree to accept a return of a specifically ordered pipe organ, due to the administration and labour costs involved there will be a nominal £250.00 charge or in some circumstances a higher value charge depending on the complexity of the original special order, which will be deducted from any refund agreed as a cost to cover the time that was spent with you in arranging your original custom order and all labour and administration involved in your subsequent cancellation.

As pipe organs are specifically made up to order and not subject to distance selling.
We reserve the right not to accept them back under the above terms and administration charge unless agreed by us in writing under very exceptional circumstances. Please note if we do accept an organ or instrument back it must be returned in exactly the same condition as it was originally supplied in, we will advise you in writing if there are any faults noted should this clause be enacted and agree a monetary value of any damage.


Cancellation and return of orders legally only applies to private individuals. Companies & businesses are excluded from the distance selling rule. (Business to business).


0.5A Leather sales

Leather is a natural product therefore it will contain natural flaws in the skin including sometimes pin holes etc. and will vary in thickness. By purchasing from us you agree and understand this and accept that natural flaws and thickness variations are an inherent fact of purchasing natural leather skins and therefore this is not an acceptable reason to return the skin for refund.

We will not accept returns based on the quality of the skin supplied. We will have had to purchase the skins in good faith from the tannery or merchant that supplies us and pay per square for them including flaws in skins. We sell skins in the same way as sold to us, as a natural product including such flaws. By purchasing from us you are deemed to accept this condition.

It is normal organ building practice to always order slightly more leather than you require so you can cut out or avoid such natural flaws that may occur within the skin. If you are at all unsure of what leather to purchase or the type required please contact us first for advice.


06. Late or Lost Deliveries:

Normal stock items will be delivered quickly usually within 1 to 3 days of order in the UK (3 to 14 days outside the UK depending on country). If your 'Stock' goods haven't arrived after 5 days within the UK or 14 days outside the UK, Please notify us of the NON-DELIVERY immediately (unless you have been informed of a later delivery i.e. a special order item).

Due to Royal Mail & Courier terms we cannot list goods as being lost in transit until after 14 working days have passed from date of posting. If the goods have still not arrived by then, we will either send out a replacement at no extra cost, or issue a full refund.

07. Children & Small Parts Warning:

Most of our products contain small parts particularly the musical items due to the musical mechanism or parts of the item.

Therefore they are not intended as toys and not suitable for small children / babies due to choking hazards and sharp objects. Small children must be supervised by an adult if using any of our products. If you are unsure of suitability, please ask one of our staff for guidance.

08. Goods Title:
 
All goods remain the property of Dean Organ Builders 'The Music Box Shop' until paid for in full and cleared by our bank. This includes all kinds of payment.

08.1 Mechanical Organ Instrument Storage: Once an order is fulfilled by Dean Organ Builders and the customer has been notified and full payment has been received and cleared at our Bank, you will be given a date by which the Organ / Instrument is to be removed from our premises.  Should the Organ / Instrument not be removed from our premises by this date, we reserve the right to charge whatever storage fee is necessary.
Should you fail to pay the final invoice payment on time we reserve the right to charge you storage on a weekly basis until payment is made in full and the Organ / Instrument collected.  This storage time will not only be levied on the new Organ / Instrument but also on any part exchange Organ / Instrument held in our stores awaiting completion of the sale.Once an Organ / Instrument is paid for and cleared at our Bank, the customer is deemed responsible for insuring the Organ / Instrument  whether it is left at our premises or not.  Any Organ / Instrument paid for is left with us at the customer's risk and we can take no responsibility for theft or damage while parked in our yard, it is the customer's responsibility to insure the Organ / Instrument and any ancillary equipment or vehicle, unless special arrangements have been made with us to provide insurance.


08.2
Once you receive your invoice payment should be made within 14 days of receipt unless you are an account customer with terms of 30 days. If you are part exchanging an Organ / Instrument as part payment you should contact us within the payment terms applicable to you to arrange to bring in the Organ / Instrument at an agreed time prior or on the day of collection.  Please note any remaining funds must be paid prior to collection of the new Organ / Instrument and bringing your part exchange.
Should you wish to bring the Organ / Instrument you are part exchanging in to us prior to completion of your purchase, we can accept this by arrangement. If taking advantage of our storage whilst waiting for your new Organ / Instrument and providing we have room we will store your Organ / Instrument generally free of charge until your purchase is complete subject to condition 08.2A.


08.2A
If however you cancel your purchase and you wish to collect your instrument from us, then you will become liable for our standard storage rate per week for the duration your instrument was with us. This may also include any insurance cost that we have been liable for whilst your organ was stored at our premises.

09. Export Sales & Foreign Currencies:

All above terms apply, plus:

All transactions have to be taken in our own currency (GB Pounds Sterling) so any prices shown in US Dollars $ and Euro € are for guidance only for USA and European residents using an estimated exchange rate. As the exchange rate alters daily, we can only work out an approximate cost. For up to date pricing in foreign currencies, please check with your bank on the current exchange rate.The prices shown do not include any import tax, duty or handling charges that may be liable upon delivery to a foreign country - please check with your local tax or customs office / couriers for likely import charges on the type of goods we sell.

10. Your privacy & Security

We are a registered company with the ICO.

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully. We are fully compliant with the current PCI Data Security Standards.


Our privacy notice will tell you how we look after your personal data and about your privacy rights and how the law protects you. You can view our privacy policy by clicking HERE.

We only collect your information for your specific transactions / orders. We will never collect sensitive information about you without your explicit consent.

We do not pass on any information to any other parties. When ordering via the internet your transaction is sent using SSL secure server technology for high security purposes.

11. WEEE Regulations

The Waste Electrical and Electronic Equipment (WEEE) Directive is now UK law. The legislation aims to make producers pay for the collection, treatment and recovery of waste electrical equipment. The regulations also mean that suppliers of equipment like high street shops and internet retailers must allow consumers to return their waste equipment free of charge.

The amount of WEEE we throw away is increasing by around 5% each year, making it the fastest growing waste stream in the UK.

Much of the UKs WEEE ends up in landfill, where the lead and other toxins it contains can cause soil and water contamination. This can have a harmful effect on natural habitat, wildlife and also human health.

Many electrical items that we throw away can be repaired or recycled. Recycling items helps to save our natural finite resources and also reduces the environmental and health risks associated with sending electrical goods to landfill.

Distributors of new Electric and Electronic Equipment (EEE) have a part to play in reducing the amount of WEEE going into landfill sites.

Dean Organ Builders "The Music Box Shop " is obliged under these regulations to offer our household or private customers free take-back of their WEEE on a like-for-like basis when they buy a new Electrical or Electronic product from us.

For example, if a customer bought a new keyboard from us we would accept their old keyboard and prevent it going into a landfill site by disposing of it safely. Customers must return at their expense the WEEE item to us within 28 days of purchasing their new item.

Under the WEEE Regulations, all new electrical goods should now be marked with the crossed-out wheeled bin symbol.

Goods are marked with the crossed-out wheeled bin symbol as shown at the bottom of this page, to indicate that they were produced after 13th August 2005, and should be disposed of separately from normal household waste so that they can be recycled.


12. Traveling charges for service work and tunings.


When we travel to tune or service instruments you will be charged our standard labour charge for the travelling time plus our standard mileage charge applicable at that time, (current mileage and labour charges are available on request).

Should your address be within a clean air zone or we are required to travel through a clean air zone to get to you we will charge you the applicable clean air zone charge plus an administration charge of £9.00 All charges will be subject to V.A.T at current rates.



13. Reservations
We reserve the right to alter/delete prices and specifications without prior notice or obligation.

We reserve the right to change these terms & conditions from time to time without prior notice. All rights reserved.

Please note that although we take as much care as possible to show pictures of the actual range of products available, because most of our products are handmade and wooden, the designs & colours may naturally vary slightly from those shown.

Please note we are the original Dean Organs company, not to be confused with other companies who trade in similar products with similar names or use website names that look like ours, we are not just web based but an established retail shop, run by a family that have continually traded from Whitchurch, Nr. Bristol since the 1930s.
